A. THE CONFIDENTIAL PROCESSING OF YOUR PERSONAL DATA

 

1. PRELIMINARY REMARK
The Internet is a great medium. Click the mouse a few times and you are following and analyzing current events, you are buying products and services and you are communicating with the whole world – even with people you have never met! AURELIS is pleased to let you discover this beautiful medium, with respect for your privacy. The protection of your privacy gets our absolute priority.

2. YOU ARE FREE TO VISIT OUR WEBSITES
You are free to visit our sites, gather information about our products and our services, take note of the latest news or our new services, without giving us your personal information. If you prefer to give us your personal information then we will process this information confidentially in accordance with the current provisions and the legal national and international regulations.

3. CONCEPT OF 'PROCESSING'
'Processing' is to be understood as any kind of automatic processing. It includes any action we do with the personal data of a natural person, such as collecting, storing, using, changing, deleting, consulting, communicating, etc. ..

4. CONCEPT OF 'CONFIDENTIALITY'
The 'confidential' processing means that we keep your personal data 'confidential', in accordance with the common legal national and international regulations, including the Belgian law of December 8th on the protection of the privacy (B.O.G., March 18th, 1993), as amended by the law of December 11th, 1998 (B.O.G., February 3rd, 1999). This way there will be no personal information of concern, such as address, email, phone and fax number, demographic data or identification data, processed without your consent (infra-6. Your admission to processing) or without you knowing the purpose of this processing (infra-5. The purpose of the processing).

5. THE PURPOSE OF THE PROCESSING OF YOUR PERSONAL DATA
If you transmit personal data, they will be included in our files and they shall be processed:
* for the management of the client base, the sites and the services provided.
* for the issuance, collection and verification of the invoices.
* to inform you about the new characteristics, new services and products emanating from AURELIS.
* for the creation of information or promotional campaigns about the products and services of AURELIS

6. YOUR CONSENT FOR PROCESSING
By providing AURELIS with your personal data, you are explicitly giving us permission to process personal information for the above mentioned purposes (see "The purpose of the processing of your personal data"). If we wish to process personal data for direct marketing campaigns we will again ask your explicit consent.

7. YOUR RIGHT TO OBTAIN INFORMATION
The person responsible for the processing of your personal data is AURELIS. If there are any questions you should appeal to AURELIS. For more general information, you can also contact the Commission for the Protection of Privacy at the Ministry of Justice. 8. YOUR RIGHT TO RETRIEVE AND CORRECT YOUR DATA
The customer proving his identity (copy identity card) can get the written report of his personal data for free, provided submitting a written, dated and signed request at AURELIS. If desired, he can also ask the correction of the data that would be incorrect, incomplete or irrelevant. Your data will be communicated to you within 45 days after the receipt of your request. In the event of a change of the administrative data of the customer, this customer shall inform AURELIS within the month the change happened.

9. REPORT OF INVASION OF PRIVACY
If you think that the AURELIS site is making an unjustified intrusion into your Privacy, you will be requested to inform AURELIS, using the feedback page. We will use all our commercial opportunities to identify and correct the problem.

 

B. PROTECTION OF YOUR PRIVATE COMMUNICATION

 

1. CONFIDENTIALITY OF YOUR PRIVATE COMMUNICATION
AURELIS respects the confidentiality of your private communication (e-mail, sms, ...) but reserves a certain control right in the exceptional situations described below (infra B. 2. Control of your private communication).

2. CONTROL OF YOUR PRIVATE COMMUNICATION
AURELIS reserves the right to information regarding to control and to explore the messages, such as the content, the origin or the destination of this messages, in case of a reasonable suspicion that the whole, or part of this communication relates to illegal or illicit activities, or if it is ordered to that end by the competent authorities.
Except when the control is done at the request of the competent authorities, the control of AURELIS may refer only to the messages with a public or confidential nature, that is, the information on a web page, the messages that can be found in the discussion groups or information mailings, without this list being limited.
AURELIS is allowed to take measures that are necessary to ensure a proper management of the computer system. In this respect, it can acquire access to any communication that is stored on its computer system.

3. PASSWORD AND ACCESS CODE
The customer shall undertake to ensure the secret and confidential character of his password and his access code. Any use of these identifiers is done on the complete responsibility of the customer.

C. AURELIS TERMS OF USE

AURELIS provides a membership service that allows our members to access AURELIS content over the Internet to PC’s, tablets, smartphones and other devices ("AURELIS ready devices").
The AURELIS service is provided to you by AURELIS i.v.z.w., a Belgian non-profit organisation. Your membership contribution goes entirely to supporting the program, the philosophy and the community. These Terms of Use govern your use of our service. As used in these Terms of Use, "AURELIS service", "our service" or "the service" means the service provided by AURELIS for using AURELIS content.
When you become member of AURELIS, you agree to be bound by these Terms and all applicable laws, rules and regulations. You may also be asked to click “I accept” at the appropriate place prior to your payment. At such time, if you do not click “I accept”, you may not be able to complete the membership process. By using the AURELIS services, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these Terms, please refrain from using the AURELIS services.

1. Membership and billing

AURELIS account holders may access the AURELIS services in two ways: Free Trial or Paid Membership.
To use the AURELIS service you must have Internet access and a AURELIS ready device, and provide a current, valid, accepted method of payment. You can find specific details regarding your AURELIS membership by visiting our website and clicking on the "Your Registration" link available at the top of the pages of the AURELIS website under your profile name.
AURELIS memberships and subscriptions are not transferable and therefore cannot be sold or exchanged or transferred in any way whatsoever.

1.1 Free Trials

1.1.1. Your AURELIS membership may start with a free trial. The free trial period of your membership lasts for one month, or as otherwise specified during sign-up and is intended to allow new members and certain former members to try the service.

1.1.2. Free trial eligibility is determined by AURELIS at its sole discretion and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible. We may use information such as method of payment or an account email address used with an existing or recent AURELIS membership to determine eligibility.

 

1.2 Paid Membership

AURELIS offers monthly, 3-monthly, annual, and lifelong subscription plans.

1.2.1. Our “Monthly” subscription is paid in monthly instalments. For each month that your monthly subscription is active, you acknowledge and agree that AURELIS is authorized to charge the same credit card as was used for the initial subscription fee or other payment method as set forth in section 3 (Billing) in the amount of the then current monthly subscription fee. The monthly renewal subscription fees will continue to be billed to the Payment Method you provided, automatically until cancelled. You must cancel your subscription before it renews each month in order to avoid billing of the next month’s subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-month subscription period.

1.2.2. Our “3-monthly” and “Yearly” subscriptions are paid for by an upfront one-off payment with automatic renewals. You acknowledge and agree that AURELIS is authorized to charge the Payment Method used for (i) the initial 3-monthly or annual subscription fee at the rate secured at the time of subscription, and (ii) the renewal subscription fee(s) at the non-discounted rate in effect at the time of any such renewal. You must cancel your subscription before it renews in order to avoid billing of the renewal subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial subscription period.

1.2.3. Our “lifelong” subscription is paid for by a one-off upfront payment.

 

1.3. Payment Methods

You can change your Payment Method by visiting our website and clicking on the "Your Registration" link. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not change your Payment Method or cancel your account, we may suspend your access to the service until we have obtained a valid Payment Method. When you update your Payment Method, you authorize us to continue charging the updated Payment Method, and you remain responsible for any uncollected amounts. For some Payment Methods, the issuer of your Payment Method may charge you certain fees, such as a foreign transaction fee or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

 

1.4. Cancellation.

You can cancel your AURELIS membership at any time, and you will continue to have access to the AURELIS service through the end of your subscription plan. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial-month membership periods or unused AURELIS content. To cancel, go to the "Your Registration" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current membership period. To see when your account will close, click "Subscription Plans" on the "Your Registration" page. If you signed up for AURELIS using your account with a third party as a Payment Method and wish to cancel your AURELIS membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the AURELIS service through that third party. You may also find billing information about your AURELIS membership by visiting your account with the applicable third party.
We may suspend or terminate your use of the AURELIS services as a result of your fraud or breach of any obligation under these Terms. Such termination or suspension may be immediate and without notice. A breach of these Terms, includes without limitation, the unauthorized copying or download of our audio or video content from the services.

 

1.5. Changes to the Price and Service Plans

We may, in our sole discretion, change our service plans and the price of our service from time to time. If you do not agree to the change, you may cancel your membership or subscription via the "Your Registration" page.

 

2. AURELIS Service

2.1. You must be 18 years of age, or the age of majority in your province, territory or country, to become a member of the AURELIS service. Minors may only use the service under the supervision of an adult.

 

2.2. The AURELIS service and any content used through the service are for your personal and non-commercial use only. During your AURELIS membership we grant you a limited, non-exclusive, non-transferable, license to access the AURELIS service and use of the AURELIS content. Except for the foregoing limited license, no right, title or interest shall be transferred to you. You agree not to use the service for public performances unless specifically granted to do so by AURELIS.

 

2.3. AURELIS regularly makes changes to the service and the content. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of AURELIS content.

 

2.4. You agree to use the AURELIS service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the AURELIS service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the AURELIS service; use any robot, spider, scraper or other automated means to access the AURELIS service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the AURELIS service; insert any code or product or manipulate the content of the AURELIS service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of the AURELIS service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

 

2.5. The quality of the display and response time of the AURELIS content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection.

 

2.6. Although we aim to offer you the best service possible, we make no promise that the services will meet your requirements and we cannot guarantee that the services will be fault free. If a fault occurs, please report it to us through the contact form on our website and we will review your complaint and, where we determine it is appropriate to do so, correct the fault. If the need arises, we may suspend access to the services while we address the fault. We will not be liable to you if the services are unavailable for a reasonable period of time.

 

2.7 Your access to the services may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the services as soon as we reasonably can.

 

2.8. Service DISCLAIMER. The information contained in the services is for general information purposes only. While we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the services or the information contained on the services for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

 

2.9 Medical DISCLAIMER

2.9.1. AURELIS is a provider of online meditation content in the health & wellness space. We are not a health care or medical device provider, nor should our services be considered medical advice. Only your physician or other health care provider can do that. While there is third party evidence from research that our services can assist in the prevention and recovery process for a wide array of conditions as well as in improving some performance and relationship issues, AURELIS makes no claims, representations or guarantees that the services provide a therapeutic benefit.

2.9.2. Any health information and links on the services, whether provided by AURELIS or by contract from outside providers, is provided simply for your convenience.

2.9.3. Any advice or other materials in the services are intended for general information purposes only. They are not intended to be relied upon and are not a substitute for professional medical advice based on your individual condition and circumstances. The advice and other materials we make available are intended to support the relationship between you and your healthcare providers and not replace it. We are not liable or responsible for any consequences of your having read or been told about such advice or other materials as you assume full responsibility for your decisions and actions. In particular, to the fullest extent permitted by law, we make no representation or warranties about the accuracy, completeness, or suitability for any purpose of the advice, other materials and information published as part of the services.

2.9.4. There have been rare reports where people with certain psychiatric problems like anxiety and depression have experienced worsening conditions in conjunction with intensive meditation practice. People with existing mental health conditions should speak with their health care providers before starting AURELIS services.

2.9.5. Do not use the AURELIS services while driving, operating heavy machinery, or performing other tasks that require attention and concentration. You understand and agree that you are solely responsible for your use of the services.

 

3. Passwords, Access Code and Account Access

The member shall undertake to ensure the secret and confidential character of his password and his access code. Any use of these identifiers is done on the complete responsibility of the member. The member who created the AURELIS account and whose Payment Method is charged (the "Account Owner") has access and control over the AURELIS account and the AURELIS ready devices that are used to access our service. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the AURELIS ready devices that are used to access the service and not reveal the password nor details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, AURELIS or our partners from identity theft or other fraudulent activity.

 

4. Indemnity

You will indemnify and hold harmless AURELIS and its officers, directors, employees and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the services or content or (ii) your violation of these Terms.

 

5. Limitations of Liability

Neither AURELIS nor any other party involved in creating, producing, or delivering the services or content will be liable for any incidental, special, exemplary or consequential damages, including, but not limited to, lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with these terms or from the use of or inability to use the services or content, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not AURELIS has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
In no event will the AURELIS total liability arising out of or in connection with these terms or from the use of or inability to use the services or content exceed the amounts you have paid to AURELIS for use of the services or content, or fifty Euro (€50) if you have not had any payment obligations to AURELIS, as applicable. The exclusion and limitations of damages set forth above are fundamental elements of the basis of the bargain between AURELIS and you.

 

6. Miscellaneous

6.1. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of Belgium. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. Any disputes relating to these terms of use, the documents referred to in them or the site or the services will be subject to the exclusive jurisdiction of the Belgian courts.

 

6.2. Class Action Waiver. In any dispute, neither you nor any other person shall be entitled to join or consolidate claims by or against other affiliates or persons, or arbitrate any claim as a representative or class action or in a private attorney general capacity. You acknowledge that you are giving up your rights to participate in a class action or representative action with respect to any such claim.

 

6.3. Unsolicited Materials. AURELIS does not accept unsolicited materials or ideas for AURELIS content, and is not responsible for the similarity of any of its content or in any media to materials or ideas transmitted to AURELIS.

 

6.4. Customer Support. To find more information about our service and its features or if you need assistance with your account, please visit our Help Centre via our website (www.AURELIS.org/help).

 

6.5. Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

 

6.6. Changes to Terms of Use. AURELIS reserves the right to change or update these Terms, or any other of our policies or practices, at any time, and will notify users by posting such changed or updated Terms on this page. Any changes or updates will be effective immediately upon posting to our websites. Your continued use of the AURELIS services constitutes your agreement to abide by the Terms as changed. Under certain circumstances we may also elect to notify you of changes or updates to our Terms by additional means, such as pop-up or push notifications within the Services or email.

 

6.7. Electronic Communications. We will send you information relating to your account (e.g. successful subscription, changes in password, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
